Intellectual Property Rights
In the event of any concerns or complaints about possible violation of intellectual property rights, please send us an email at ✉ ip@whosebilling.com, identifying with specificity the rights alleged to be violated and the accused products. Note: This email address is just for intellectual property rights and legal issues, other requests may not get respondence.
Complaint handling. Your notice should identify: the right you rely on and, where applicable, the registration number; the material you say is infringing, with the specific URL or location; your name, address, telephone number and email address; a statement that you have a good-faith belief that the use is not authorised by the rights holder, its agent or the law; a statement that the information in your notice is accurate and that you are the rights holder or are authorised to act on the rights holder's behalf; and your physical or electronic signature. We may remove or disable access to the material concerned, notify the person who uploaded it, and provide that person with your notice. Knowingly submitting a materially false notice may expose you to liability.
Disputes. Any dispute, claim or proceeding arising out of or relating to intellectual property rights in the Site, its content or our products is subject to Section 20 of our Terms of Service, which contains an agreement to resolve disputes by individual binding arbitration and a waiver of the right to participate in a class or representative action and to a trial by jury, and to Section 13 of those Terms, which limits our aggregate liability to the greater of the amount you paid us in the 90 days before the event and US$500, and in any event to US$5,000 in total.
Either party may instead seek injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation or unauthorised use, and either party may bring a claim that qualifies for small claims court. Where the law applicable to you does not permit the arbitration agreement or the class action waiver to be enforced against you, those provisions do not apply to you to that extent and the remainder of our Terms of Service continues to apply.
